What are the legal duties of a Private Investigator?
Provide investigative services for individuals, businesses and attorneys; plan and conduct investigations to support litigation, appeals, civil rights actions, discrimination and employment matters. Private investigators track down witnesses and obtain statements and locate physical evidence that might prove a client's innocence or demonstrate a strength in the plaintiff’s or defendant's action.
Private investigators are also quite skilled in interviewing anyone who may have an impact on a case.
Private investigators (Private Detectives) investigate crimes , affiliations, associations, transactions, reputation or character of any person, group of persons, association, organization, society, other groups of persons, firm or corporation. Private investigators conduct surveillance; perform background checks on vendors, contractors and suppliers; perform due diligence to determine the honesty, efficiency, loyalty of people or activities of employees, agents, contractors, and sub-contractors.
Private investigators secure evidence to be used before any authorized investigating committee, board of award, board of arbitration, or in the trial of civil or criminal cases.
Private investigators review and analyzes police reports (Expert Witness); statements, diagrams and photographs.
Private investigators consult with expert witnesses; contact and coordinate with various agencies to obtain or verify information, facts and evidence; conduct computer and legal document searches.
Private investigators operate electronic surveillance equipment and cameras; supervise polygraph examinations; review crime scene evidence; construct time sequence charts; and assist in preparing court presentations. Private investigators can serve legal process and subpoenas (Process Server) on forensic labs, police organizations and other agencies in connection with the client; and to witnesses, defendants and parties of interest; coordinate and protect witnesses going to court and prepare witnesses to testify truthfully.
Private investigators can act as bail enforcement agents (Bail Agent); engage in the business of enforcing the terms and conditions of a person’s release from custody on bail in a criminal proceeding, including locating, apprehending and returning any such person released from custody on bail who has failed to appear at any stage of a criminal proceeding to answer the charge before the court in which he may be prosecuted.
Private investigators can act as watchmen, guards, security officers or private patrolmen protecting individuals (Executive Protection) or property (Security Officer); prevent the theft or the unlawful taking of goods; prevent the misappropriation of goods, money, bonds, stocks, notes or other valuable documents, papers, and articles of value; and procure the return of these items.
